Phineas Horton of the township of Chester in the said County of Morris being duly

sworn according to law on his oath saith that he is seventy eight years of age on the seventeenth day of February last - that he was born in the said county of Morris and has during his whole life tim resided therein, that the deponent had a brother named Nathan Horton who was about twenty years older than the deponent - that deponent has frequently seen his said brother Nathan and knew him well - that deponent has been frequently informed and understands from the said Nathan - from the deponents father from deponents other brothers and from old persons heretofor resident in the said county of Morris that the said Nathan served in the war of the revolution with the american troops and further that the deponent although a boy at the time has a personal knowledge of the fact remembering well when said Nathan use to go out in the service. That the deponent has always understood that the said Nathan was married in the State of New York about the time peace was concluded between the United States and Great Brittin at the close of the revolutionary war - that the maiden name of the wife he married was Elizabeth Eagles - that the said Nathan and his said wife Elizabeth visited deponent about the year seventeen hundred and eighty four and remained with deponent at his home about eight months - deponent has been informed and understood that the said Nathan Horton soon after he was married removed to the State of North Carolina and continued to have his residence there until he died, that deponent has understood the said Nathan died in July eighteen hundred and twenty four and deponent saith that during the life of the said Nathan and while the said Nathan resided in North Carolina said Nathan and deponent corresponded with each other by letters. And deponent further saith that he has never heard that Elizabeth the wife of the said Nathan has died and so far as deponent knows she is still living.
